CHC50908 - Managers & Employers Legal Obligations Regarding OHS & Culture of Safety

I confused with the legal obligation of employer and manager in relation to OHS and how can culture of safety be implemented by themanager considering both adulths and children ?

Here is some info that you can use to help with your assignment…

1) Legal Obligations of manager regarding OH&S-

• Complies with all relevant legislation and statutory requirements, codes of practice and industry standards and makes adequate provisions of resources to meet these requirements.
• Promotes, health and safety awareness and the development of healthy and safe work practices.
• Provides information, training, instruction and adequate protective equipment.
• Consults with employees on health and safety matters and on ways to reduce workplace hazards and improve control systems.
• Maintains effective accident and analysis and hazard reporting systems.
• Encourages the rehabilitation of employers.
• Sets health and safety objectives and regularly reviews performance.

2) Legal Obligations of employers regarding OH&S-

• Accept responsibility for protecting themselves and others.
• Comply with all relevant legislation and statutory requirements and working procedures, codes of practice and industry standards.
• Report and where appropriate rectify hazards.
• Participate in the analysis of accidents.
• Wear appropriate protective equipment.

3) How can culture of safety be implemented for both adults and children:

The centers occupational health and safety policies, procedures and programs are the centers implementation plan for complying with the government legislation and regulations. These can also include:
• Program plans for children’s activities.
• Materials Safety Data Sheet (MSDS).
• Self storage, operation and cleaning guideleines.
• Good hosekeeping principles.
• Infection control procedures, universal precautions and specific precautions
• Hazard analysis and risk management plans
• Assumptions based on common sense
• Instructions for operating machinery
• Children’s health and safety policies, procedures and programs
• Standard operating procedures
• Food safety programs
• Disaster response plans
• Emergency and evacuation plans.

There is another point that I would like to add regarding the legal obligations of employers.

Employers are required to nominate a member of management to be responsible for OH&S issues. The regulations usually require the employer to meet with the member responsible for OH&S issues and discuss (where possible) if the identified risk can be isolated, who is affected by the risk and the time line for permanently controlling the risk.

The employer should have an agreed procedure for dealing with OH&S issues, if not, the employer must follow the procedures stated in the regulations.
