Q..what is the family law act and why it is important for a child care educator to be familiar with it

MY ANS...This act consists of a set of rules and regulations relating to the legal rights and responsibilities of parents and children.it is common wealth legislation and is administrated by the family court of Australia.Childhood educator need to have a clear understanding of who has legal responsibility for children in order to make effective and appropriate decisions concerning the children in their care.it is necessary to be familiar with the old and the new terms of commonwealth power (family law-children)Amendment Act 1996 No 60,both the old and the new terms as cares determined before 1996 will use old terminology.

Q2...Desribe the procedure you should follow if an unauthorized person comes to center to collect a child.

My Ans... I will be polite,firm and clear and remember my primery duty is to children in my care
I will clarify the legal position with the unauthorised person "I am sorry but I am not legally able to allow the child to leave with you without the permission of the parent/person with whom the child lives.
I will politely ask the child to leave.

Describe the procedure you should follow if an unauthorized person comes to center to collect a child.

You would need to contact the parents to confirm. Once the parents have confirmed you have to ask the unauthorized person for photo I.d, such as a drivers license with their name to verify who they are. Then they are able to collect the child from the centre.

Unauthorised person just means that the parents haven't put them on their child's enrolment record to collect their child from care. This usually happens when grandparents are visiting or aunts and uncles... You obviously can't add everyone on the list as an authorised person. Unauthorized person doesn't mean that they are excluded from picking up the child, it just means you need to obtain verbal confirmation from the parent first.
