Legal Requirement
Under Section 172(3) and (4) of the National Law NSW, all ECEC services must display their compliance and quality history within their service premises.
Purpose
To enhance transparency for families and support informed decision-making about their child’s safety and well-being.
When to Start
- The requirement is now law.
- Enforcement begins 20 November 2025, allowing time to prepare and comply.
What Must Be Displayed
Use the short-form compliance and quality history template provided by the NSW Regulatory Authority. It must include:
- Compliance history from the past 2 years (or since approval/transfer)
- Any prosecution actions (guilty pleas, convictions, penalties)
- Current and previous quality ratings
- Compliance actions under review
- The template must be displayed even if there is no history or rating
How to Access and Complete
- Download the approved short-form template
- Retrieve compliance data from the NQA ITS portal
- Include any prosecution details not listed in the portal
- Follow the ministerial guideline for correct completion and display
Talking to Families
- Be proactive in explaining your compliance history
- Share actions taken to resolve issues
- Build trust through transparent communication
- Make records available upon request (Regulation 177(3)(b))
Updating Your Display
- Update within 7 days of any new compliance action appearing in the NQA ITS ‘Compliance Summary’ report
Penalties for Non-Compliance
If you fail to properly display the required information:
