family day care absenses and fees

Could someone clear up an issue I have come up against. If a child has absenses for a holiday is it legal for carer to not charge the parent the amount that they pay and still recieve the CCB?
This came from a discussion I had with another carer. would like to hear your views on this.

If the carer is not charging the parent, then they should not be collecting the CCB.
