Legislation in child care

1. Legislation and Childhood Education and Care Services:
a. Identify the piece of legislation related to discrimination against the features of diversity listed below.
b. Discuss the impact of each piece of legislation on work and social practices in Early Childhood Education and Care services.
This may be in the form of rights or responsibilities of workers, employers, or clients.
c. Cite the one (1) consequence of breaching each of these pieces of legislation.

i. Age Age Discrimination Act,2004 - Encourage no discrimination on the basis of age.

ii. Sex Sex Discrimination Act, 1984 - Encourage others to be sensitive to the individual preferred gender.

iii. Race Racial discrimination Act, 1984. - Invoke empathy.
- Anti racism awareness.
- Promote cultural sensitivity.
- Cross cultural work teams. - Being treated differently.
- Performing mundane tasks.
iv. Disability Disability Discrimination Act, 1984. Children with disabilities are active participants and not just observers on the sideline. - Lack of recognition.
- Power imbalance.


Please advice where to get info about sex and gender discrimination in child care setting?

I found this in the Sex Discrimination Act:

35 Residential care of children

(1) Nothing in paragraph 14(1)(a) or (b) or 16(b) renders it unlawful for a person to discriminate against another person on the ground of the other person’s sex in connection with a position as an employee or contract worker, where the duties of the position involve the care of a child or children in the place where the child or children resides or reside.

(2) Nothing in paragraph 14(1)(a) or (b), 14(2)(c) or 16(b) renders it unlawful for a person to discriminate against another person on the ground of the other person’s marital or relationship status in connection with a position as an employee or contract worker of a particular employer or principal, where:

(a) the duties of the position involve the care of a child or children in the place where the child or children resides or reside; and

(b) it is intended that the spouse or de facto partner of the occupant of the position would also occupy a position as an employee or contract worker of that employer or principal.
