hey everyone,
i need some help with my legal assignment as i am having trouble with my answers to part 2,
i have been asked to resubmits it and would really appreciate any help you could give me.
below are the questions and my current answers to them:( plus the feed back i was given for them )
-3. What sections of the UN rights of the child do these scenarios link to?
• Children have the right to protection from violence, abuse and neglect, and from being hurt or mistreated, physically or mentally.”
• Article 19, Convention on the Rights of the Child, 1989
• http://www.unicef.org.au/our-work/what- ... protection
(You have outlined who the legislation applies to in the ACT not the actual names of the legislation as required. Please review your learner materials and clearly identify the state and federal legislation that applies to these scenarios.)
4. What are the laws/acts in your state/territory that you need to follow in relation to reporting risk of harm? (State and commonwealth)
• ACT- people that are employed in jobs that are related to the health and or safety of children/young people or their families are mandated to report abuse or suspected harm.(You have correctly identified the relevant section of the National Quality standards. 2.3.4 is the most relevant to these scenarios. )
6. Can you share information from these scenarios with other organisations? Explain your answer.
• You can only share the information first with the room leader and if necessary the police.
• Once the police are involved you may not share the information with anyone.
(Kayla, yes you can share information with your room leader and the police. There are certain circumstances in which you can share information with other bodies such as schools. Please review your learner materials regarding this and re answer the question)
8. Looking at the approved learning framework for your state, explain how you would use the outcomes to provide ongoing support and learning for James and Lucy.
• There are 5 outcomes
-Being healthy
-Making a positive contribution
-Staying safe
-Economic wellbeing.
-Enjoying and achieving
• In both the cases of James and Lucy the one that stand out the most is staying safe.
-the first step to keeping them safe is to have had a report
-to look out for future signs and just to continue to care for their wellbeing following my duty of care.
(Kayla, you have outlined how the records need to be kept confidential, well done. If the records are being kept electronically then they need to be kept in a password protected file.)
9. What cultural considerations will you need to consider in relation to James and Lucy?
• Lucy’s mother is Aboriginal
(You have outlined what the outcomes of the learning framework are although it is unclear which framework you have used when doing so. Please identify the framework that you are using and outline how you would use the outcomes of this framework to guide your work with the children. This may include the experiences you would plan and the strategies you would put into place.)
