Work Place Seeking Specialist Legal Advice

Hi all my assessment is on legal and ethical

Question I am Trying to answer is

Explain the situation in the workplacewhere the organisation would need to see specialist legal advice.

I would like to know if I am on the right track.

My situation would be if a child was sent home with someone other than the primary care giver. If no IDs we checked And the parent was not contactable by The educators and this child was sent home with someone else and the primary care giver comes to collect the child but able to compare then press charges against service investigated

I have another question that i need to identify 3 legal responsibilities of a centre director
i hav said

1 adhering to ratios
2 making sure policies are being followed
3 and duty of care of staff and children

am i on the right track?

any other legal responsabilities

Also what are the consequences if you or your team breach your duty of care responsabilieties ?

I said the centre would be investigated and depending on the investigations a hefty fine would be issued. is that enough?

For assessment question 1.4 it asked me to provide three examples of legal issues that could all have a reason in your workplace I have said children being 1.picked up by somebody un authorised 2. preaching in confidentiality having a hard time coming up with the third example.

I also have a question that asked me to identify three policies and procedures which your organisation follows in regards to safety and well-being of children in the workplace and discribe one of these in detail. I said 1. emergency evacuation 2.court orders 3.and lockdown policy what other examples can I use? Am I correct?a

I am also stuck on what types of insurance organisation must have to cover itself from a legal and compliance standpoint. Can someone direct me to our website where I can find the different insurances?

Also for practices that are prohibited by law I have said heating children discrimination neglectAnd abuse am I on the right track?

Question 1.14 and asks me what steps are you required to follow accordingTo organisational policy and procedures if you observe Discrimination in the workplace am I on the right track when I said the grievance policy and the behaviour management policy?


I am also having trouble in finding the universal declaration of human rights if anyone has a website could they please guide me to it?

1.16 asks me what is informed consent and provide an example of when an individual would need to provide consent relevance to your industry

My answer was providing consent for taking photos of children to use four observations. Am I on the right track?


Question 1.18 asks me what are your responsibilities in maintaining an individual's confidentiality and privacy I answered that you ou need to keep it between the parties involved. Is this okay? How can I elaborate?

Professional boundaries- I need to give an example of how are you maintained professional boundaries but I am stuck can someone give me some guidance? I know this is an easy question but I've struggled


Can someone also Point me in the direction of where to find the code of ethics relevant to the industry?


The question 1.23 I need to list three responsibilities of clients in the service. I have said that the clients responsibilities aretoo
1. pay on time
2 pick up the children within the centre hours
3. And adhere to policies

Am I on the right track? Also what other examples could i use?

I then need to State how this applies to my job role so I said paying on time applies to my job role as I need to make sure that all the accounts balance and make sure debt is being paid to keep costs down. For picking up children I said this applies to my role as we are not covered for insurance outside of these hours. We could also be fined and if children are not picked up on time emergency services will have to be called if parents or other authorised persons cannot pick up their children.
In my role if we do not adhere to policy we can get fined or investigated am I correct in saying this?


And I'm unsure as to how the team adhears to each of these three responsibilities for picking up with children I saidCall emergency contacts and if emergency contacts are not available to pick up emergency services will be called and for a hearing to policies making sure that it is the team's responsibility that the centres promoted well. I still need a reason for how your team adheres to the responsibility of paying fees on time really needing some assistance with this.


Can someone please point me in the direction of where I can find organisations or associations that provide regular Tory and other information services for our industry in Victoria
Question 1.25 asks me what is the quality assurance process relevance to our industry where can I find this?

Question 1.30 asks me what are the consequences is an organisation is found non-compliant after and accreditation or rating and assessment audit I said they can get a second chance to redeem themselves and if they still do not pass they get fined investigated and closed down am I right?

1.33 list the types of legal documentation that are you that you are required to keep this part of your role

I have said policies and procedures, appraisals, enrolment forms, immunisation records other any more?

Question 1.36 asks what is your role and what are your responsibilities in regards to compulsory mandatory reporting in your state Territory. I said that's my role is of most important as IM looking after the best interest of the children and staff and I have every right to be a Mandatory reporter and add ticket for the children and staff.? Is there anything else I need to include?

Or your help would be greatly appreciated with all these points that I have made and these questions that I posted as I am having quite a lot of trouble with this part of my assessment expressly because it's all about the legal side of things
