i HAVE THIS SCENARIO AND SEVERAL QUESTIONS WHICH I HAVE ALMOST COMPLETE JUST STUCK ON A COUPLE. And I need to hand this in tomorrow.
Eleni has been an educator with the Family Day Care Scheme for two years. She is always very careful about safety, but one day her school-aged children forgot to close the gate when they left for school. A few minutes later, 3 year old Mara ‘escaped’ from the yard and went out on the road. She was almost hit by a car, then she fell and hit her head on the gutter. She required ambulance attention. Mara’s parents were very angry about the injury and are discussing legal action. Eleni, the educator, is understandably distressed about the situation, particularly seeing she is always so careful about keeping the environment in good repair, and supervises the children closely all the time. She had been watching Mara, along with the other three children in her care, but was just not quick enough to notice the open gate and Mara’s quick exit.
This is the question I am stuck on:

The approved provider of a centre-based service must ensure that the education and care service premises (including toilets and nappy change facilities) are designed and maintained in a way that facilitates supervision of children at all times that they are being educated and cared for by the service, having regard to the need to maintain the rights and dignity of the children.

For the second question, I found this within the regulations:
Assessments of family day care residences and approved family day care venues
(1) The approved provider of a family day care service must conduct an assessment (including a risk assessment) of each residence and approved family day care venue of the service—
(a) before education and care is provided to children at the residence or venue as part of the service; and
(b) at least annually—
to ensure that the health, safety and well being of children being educated and cared for by the service are protected.

From the scenario the gate seems to be in an area where the educator cannot properly be supervised so this needs to be addressed. During the times when children are being picked up maybe Eleni can ensure that she groups the children together and to only release them with their parents. A reminder sign on the gate to be closed at all times should also be provided. Eleni should also be placed in a position where she can supervise all children and the gate as well during pick up times/
