Regulations & National Quality Standard Regarding Sun Safety

Post by niddy71 » Sat Nov 21, 2015 1:00 pm

My Q was..

Identify which sections of the Regulations and National Quality Standard could be referred to when explaining your responsibilities to children with regards to sun safety.

My answer was..
Standard 2.1 each child’s health is promoted.
Element 2.1.1 each child’s health needs are supported.
Element 2.1.2 each child’s comfort is provided for and there are appropriate opportunities to meet each child’s need for sleep, rest and relaxation.
Standard 2.3 each child is protected.
Element 2.3.2 every reasonable precaution is taken to protect children from harm and any hazard likely to cause injury.

Trainers response to my answer...
You have correctly identified the National Quality Standard that could be referred to, but you have not identified a regulation.

Not sure what the Reg is....Maybe 168 ??

Maybe the following:

114 Outdoor space—shade

The approved provider of a centre-based service must ensure that outdoor spaces provided at the education and care service premises include adequate shaded areas to protect children from overexposure to ultraviolet radiation from the sun.

Ref: National Regulations

Hope this helps,

Hi Lorina..

This is what I ended up finding and putting down..

Education and Care Services National Law Act 2010 Section 167 Protection from harm and hazards. Education and Care Services National Regulations 2011:
Reg 100 Risk assessment for excursions
Reg 113 Outdoor space: natural environment
Reg 114 Outdoor space: shade
Reg 168 (2)(a)(ii) Policies and procedures: Sun protection.

You have addressed the National Quality Standard correctly. However you have not answered the question supplying the correct regulation. Consider a regulation based around sun protection policies and procedures.
Please re-submit
Unfortunately you have still not listed the correct regulation, but you are close. Consider a regulation based around services

I'm sorry I missed your question...Did you end up finding the right regulation for this? I'm currently having a look at the regulations and haven't been able to come across anything else regarding sun safety... I'll keep looking...

I just read through the whole regulations twice and all I could find addressing Sun Safety is:

114 Outdoor space—shade

The approved provider of a centre-based service must ensure that outdoor spaces provided at the education and care service premises include adequate shaded areas to protect children from overexposure to ultraviolet radiation from the sun.

You have included this in your answer above... Maybe your trainer missed it...
