The parents of Evan (4) and Rebecca (2) have recently separated and drawn up a formal parenting plan, listing both parents as carers for the children. One day the mother confides in you that she is in a new relationship and asks that the children's father not be allowed to collect them from the centre, only herself or the new partner, in order prevent the children becoming confused about their new family.
1. What are your legal responsibilities in regards to the mother's request?
2. What state regulations would guide your actions?
3. What are your duty of care responsibilities to this family?
What is your answer so far or What have you done so far as an attempt to solve this question?
I'm unsure about what regulation really covers this... the Childrens Services Regulation 2004 only really touches on what to do in regards to a person who is restricted by court order from seeing/collecting a child.
For the first question I'd probably tell the mother that we can't prevent the father from collecting the children, as in their parenting plan he has the same access rights as her, and that she'd need a court order to prevent him collecting them. But that doesn't really cover my 'legal' responsibilities...

I think that any custody lawyer give you proper advice for that question. So consult with any lawyer. leemeierlaw
