New Child Safety Laws Take Effect Today Across Australian Early Childhood Services

Today, 1 September 2025, marks a pivotal shift in Australia’s early childhood education landscape, with strengthened child safety regulations now officially in force under the National Quality Framework (NQF). These reforms—fast-tracked following the national review of child safety arrangements—aim to close regulatory gaps, improve incident response, and safeguard children in increasingly digital environments.

What’s Changed As Of Today

Safe Use of Digital Technologies (Regulation 168)

Services must now have formal policies and procedures governing:

  • The taking, use, storage, and destruction of images and videos of children
  • Parental authorisation for digital content
  • Use of surveillance devices (e.g., CCTV)
  • Use of service-issued digital devices
  • Children’s access to digital technologies

ACECQA has released guidelines and model codes to support services in implementing these policies.

Faster Notification Timeframes (Regulation 176)

Services must now report allegations or incidents of physical or sexual abuse within 24 hours, down from the previous 7-day window. This change reflects a national push for rapid, transparent response to serious safety concerns.

Vaping Ban in ECEC Environments (Regulation 82)

Effective today, vaping substances and devices are prohibited in all early childhood service environments. This aligns with broader public health efforts and reinforces the sector’s commitment to safe, smoke-free spaces.

What’s Coming Next

From 1 January 2026, refinements to the National Quality Standards (NQS) will take effect, with child safety explicitly embedded in:

  • Quality Area 2: Children’s Health and Safety
  • Quality Area 7: Governance and Leadership

These updates will require services to demonstrate proactive, embedded safety practices across operations, staffing, and leadership.

What Educators and Leaders Should Do Today

  • Review and update policies: Ensure your digital technology, incident reporting, and health policies reflect the new regulations.
  • Train your team: Host a briefing or PD session to unpack the changes and clarify staff responsibilities.
  • Engage families: Communicate the updates clearly, especially around digital content and safety protocols.
  • Audit your environment: Remove any vaping-related items and assess digital device use across the service.
  • Prepare for NQS refinements: Begin embedding child safety into your QIP and leadership practices.

Today’s reforms are more than regulatory—they’re relational. They ask us to reimagine safety not just as compliance, but as culture. As of 1 September 2025, every educator, leader, and provider becomes a frontline guardian of child safety in a digital, fast-moving world.
