Pays and levels

Hi all just wondering if someone can help me?

I am having a hard time finding out what me level I am.. I have worked in childcare for 4 years. Started my !employment as a cert III trainee, then after that I completed my diploma. I am one year and 6 months post diploma. I looked on the wages chart and I'm a level 4?? Is that right?

My boss has been under paying me I'm sure. Not sure how much per hour ? I dint find the chart helpful!

Also she dosent really pay annual leave or sick days . They pretty much pay you 15 hours a week ( I am perm part time doing 15 hours a week) anything over which usually upto 18 hours a fortnight is time in leui! One for fortnight did 22 hours over as she called me to come in unexpected and didn't pay me ! Told me I can have days off ??? What is going on?!!
How can I have days off when I'm roster for 3 per week and she needs me these days??

Also she is charging me for days when my son isn't even there, like it shows on my chikdcare benifit she has charged centrelink for $70 a day on days she hasn't even had me rosted on ( I take my son to work with me) is this fair?? I refuse to pay for the days he isn't there as she told me in the beginning no set days just bring him in when u work n it's okay?

She is not losing a place because she has no limit to how many babies she has. She just books as many as they come sometimes there is took many babies for staff so I can't see how she is losing money from the days he dosent attend if she is claiming for CL then isn't she getting the money anyways for the days he wasn't there? I see it on the statement!

Now recently I was coming home from work and was struck by a car 2 weeks off possibly more for a bad leg injury and they are saying they won't pay me as I'm not working. Where is my leave when I need it?

What can I do?

Sorry to hear about your accident! Hope you get better soon!

Based on the information you have provided according to the Children's Services Award 2010, completing 1 years service in the industry as a Diploma trained, you're hourly minimum wage is $23.48 (this amount has recently been increased) and your Level 4.2.

According to your entitlements you should be receiving the same as a full time employer (sick day and holiday leave). Here is some more information from Fair Work Australia:

Regarding your child's placement I think you should only be paying for the days you booked and the days he attends. So for example: if you work mon, wed, fri and your son is booked on those days then those days should be paid for. The other 2 days you should not be paying for. However, if you are booked for mon, wed and fri and you're child doesn't attend then you may be charged if your child is booked in full time to keep his spot.. However, there may be an understanding between you and your employer in regards to your son attending while your working.

You are definitely entitled to your leave! If your employee isn't cooperating give Fair Work Australia a call and they will advise you on what to do next.

This sounds very dodgy to me. She definitely needs to pay you for the extra hours you work. Time in lieu is only for full-time staff working over the full-time limit (37.5 hours a week) and only for overtime not for whole shifts! If you are permanent part time, any additional shifts you get should be paid! Also the fact she just takes however many babies happen to turn up is definitely against regulations. Centres are licensed for particular numbers of children in each room, this is defined by space and staffing ratios. I would be claiming my time in lieu and finding another job but at the very least she needs to know these practices are not acceptable, the reason people like this get away with it is when nobody does anything about it...
