Asthma/Anaphylaxis Policies and Legal Requirements

Hello there,

I am very new to this forum, so I hope I am doing everything right.

I am struggling with this question:
What are the organisational policies and legal requirements for managing children who have allergies/anaphylaxis or asthma?

So far I have only found
Regulation 90 and 91 and the Australian policies for
Allergies
Anaphylaxis
Asthma

I am not sure where else to look especially for the policies and if I need to write down the actual contents of the regulation or if naming them is sufficient?

Thank you for your help!

You could also include:

246 Anaphylaxis training

(1) This regulation applies in a participating jurisdiction if, immediately before the scheme commencement day, the former education and care services law or the education law of that jurisdiction did not require the attendance at an education and care service of an educator trained in anaphylaxis management.

(2) Regulations 136(1)(b) and 136(3)(b) do not apply in relation to that service before 1 January 2013.

247 Asthma management training

(1) This regulation applies in a participating jurisdiction if, immediately before the scheme commencement day, the former education and care services law or the education law of that jurisdiction did not require the attendance at an education and care service of an educator trained in asthma management.

(2) Regulations 136(1)(c) and 136(3)(c) do not apply in relation to that service before 1 January 2013.

94 Exception to authorisation requirement—anaphylaxis or asthma emergency

(1) Despite regulation 93, medication may be administered to a child without an authorisation in case of an anaphylaxis or asthma emergency.

(2) If medication is administered under this regulation, the approved provider or nominated supervisor of the education and care service or family day care educator must ensure that the following are notified as soon as practicable—
(a) a parent of the child;

(b) emergency services.

You would also need an asthma action plan for the child which will state in the centres asthma policy:

Asthma Action Plans

Hope this helps!

I think you will need to name the regulation, for example "247 Asthma management training" and the centre policy with a sentence or two about what it states.

Thank you so much Lorina!

I have read only great things about you here ;-)

Since posting this question I have come up with these regulations:
90-95, 136 and 246 and 247.

I have named the centres policies and included the equal opportunity act and privacy act 1988.

What do you think?

Thank you!
