6.Describe the emergency and evacuation procedure for an education and care service setting and/or a family day care setting.

97 Emergency and evacuation procedures
(1) The emergency and evacuation procedures required under regulation 168 must set out-
(a) instructions for what must be done in the event of an emergency; and
(b) an emergency and evacuation floor plan.
(2) For the purposes of preparing the emergency and evacuation procedures, the approved provider of an education and care service must ensure that a risk assessment is conducted to identify potential emergencies that are relevant to the service.
Penalty: $2000.
(3) The approved provider of an education and care service must ensure that-
(a) in the case of a centre-based service, the emergency and evacuation procedures are rehearsed every 3 months by the staff members, volunteers and children present at the service on the day of the rehearsal and the responsible person in relation to the service who is present at the time of the rehearsal; and
(ab) in the case of a family day care service, the emergency and evacuation procedures are rehearsed every 3 months by each family day care educator and the children being educated and cared for by the family day care educator on that day; and
(b) the rehearsals of the emergency and evacuation procedures are documented.
Penalty: $2000.
(4) The approved provider of an education and care service must ensure that a copy of the emergency and evacuation floor plan and instructions are displayed in a prominent position near each exit at the education and care service premises, including a family day care residence and approved family day care venue.
Penalty: $2000.
Note : A compliance direction may be issued for failure to comply with subregulation (2), (3) or (4).
What is your role as an employee in relation to WHS and a safe environment?
1.Work safely to protect themself and others from injury and follow all WHS instructions, for example:
wear all personal protective equipment provided.
follow safe work procedures.
not interfere with or misuse anything provided by the employer (equipment, signs, etc.) that is
used to keep the workplace safe.
not remove or change machine guards.
not behave in a way that puts themselves or others at risk.
respond to a reasonable request to provide assistance or first aid to an injured person at work..
2. Report any WHS issues, including hazards, injuries, illnesses and near misses.
8. What is the PCBU role and responsibility in relation to WHS and a safe workplace?
The WHS Act specifically includes the following measures which must be taken for workers and other persons:
A safe work environment, plant and structures
Safe systems of work
Safe use, handling and storage of plant, structures and substances
Adequate facilities for the welfare of workers at work
The provision of information, training, instruction and supervision for work to be carried out safely
Monitoring of worker health and work conditions.
To workers
workers engaged, or caused to be engaged by the person
workers whose activities in carrying out work are influenced or directed by the person while at work in the business or undertaking.
To other persons
A PCBU must ensure, so far as is reasonably practicable, that the health and safety of other persons is not put at risk from work carried out as part of the conduct of the business or undertaking.
A PCBU will be liable if they expose another person to risk to their health and safety and the risk arose from work carried out as part of their conduct of the business or undertaking.
