CHCECE020 – Establish and implement plans for developing cooperative behaviour

Post by *Mel* » Sun Aug 13, 2017 9:03 pm

Hi I was just wondering if someone could please let me know if I am on the right track with my assessment.
Research the current legislation/best practice relating to the child with additional needs. You may find the following documents useful: The UN Convention of the rights of the child, Code of Ethics, Children’s Services Regulations, EYLF/ My Time My Place – Framework for School Age Care, National Quality Standards
• What legislation or best practice did you identify?
• Where did you find this information?
• When was this legislation implemented?

What legislation or best practice did you identify?
Disability Discrimination Act 1992 - Provides protection for everyone in Australia against discrimination based on disability. Disability discrimination happens when people with a disability are treated less fairly than people without a disability.

This legislation is about including and supporting all children regardless of their disability. Whether they attend mainstream or special schools, children with disability have the same education rights as all other children. In Australia, the right to educational opportunities is protected by law.
All children’s education rights are protected by a law called the Disability Standards for Education 2005. The Disability Standards for Education 2005 are part of the Commonwealth Disability Discrimination Act 1992. These Standards set out the rights of students with disability and how education providers, like schools and universities, must help students with disability.
The main aim of the Disability Standards for Education is to give students with disability the same educational opportunities and choices as all other students. The Standards protect any person with disability who is enrolled in, has been enrolled in, or who has approached an education provider about enrolling in a preschool, school, college, university, TAFE or any other organisation that educates people.

From 1 July 2007, the Disability Act 2006 (‘the Act’) is the new legislation for people with a disability in Victoria. It replaces the Intellectually Disabled Persons’ Services Act 1986 and Disability Services Act 1991.
The Act provides for:
• A stronger whole-of-government, whole-of-community response to the
rights and needs of people with a disability, and

• A framework for the provision of high quality services and supports for
people with a disability.
The Act can be viewed on the Victorian Legislation and Parliamentary Documents website in the Victorian Statute Book section (www.legislation.vic.gov.au).

Where did you find this information?
I researched The UN Convention of the rights of the child, Code of Ethics, Children’s Services Regulations, EYLF/ My Time My Place – Framework for School Age Care, National Quality Standards, but a lot of my information I found related to legislations related to children with additional needs come from the following websites.
http://www.cyda.org.au/rights_and_legislation
http://raisingchildren.net.au/articles/ ... ntext/1299
http://www.dhs.vic.gov.au/__data/assets ... ersion.pdf

When was this legislation implemented?
Disability Discrimination Act 1992- The Disability Discrimination Act 1992 (DDA) was an act passed by the Parliament of Australia in 1992 which prohibits discrimination against persons with disabilities. Reference: https://en.wikipedia.org/wiki/Disabilit ... n_Act_1992

Disability Act 2006- The Disabilty Act 2006 was implemented 1 July 2007. Reference: http://www.dhs.vic.gov.au/__data/assets ... ersion.pdf

Kind regards.
