To demonstrate your knowledge of this important area, please state the four areas where Michael has shown negligence in his duty of care in the following scenario.

Michael was a new team member who has worked at the centre as a casual for the last month, this was his first day doing an early open shift at the centre, Susie the other educator has worked at the centre for 2 years was verbally guiding Michael through the morning set up routine. Susie failed to tell Michael about the routine safety check of the outdoor playground. Later in the day during outside play, one child playing in the sand pit sustained a needle stick injury.


To demonstrate your knowledge of this area, please state what changes could be made to avoid staff missing the safety check in the future?
The Director talked to Michael about failing to do the outdoor playground check and he explained to her that he was unaware that it had to be completed.
As an educator, you must be aware of and adhere to confidentiality policies and procedures at all times.
To demonstrate your knowledge of these requirements, please read the following scenario and answer the question below.

Michael showed a group of parents the incident report which disclosed the identity of the child who sustained the needle stick injury.

In approximately two sentences explain how each of the following relates to your work as an educator in a children’s service. How would you implement the current document into your work role?
United Nations Convention on the Rights of the Child 1998.
Look at Article 31 and relate it to your work role
• This act ensure Children have the right to relax and play
• In day-care children can join in a wide range of cultural, artistic and other recreational activities
• children have the right to life, survival and development.
Educator make sure all children should be entitled to basic rights without discrimination.
The best interests of the child should be the primary concern of decision-making in childcare;
1. Early Childhood Australia Code of Ethics.
Look at point 1 under the section titled “In relation to children, I will …”
• This will use to recognise children as active citizens participating in different communities such as family, children’s services and schools.
• It helps to create and maintain safe, healthy environments, spaces and places, which enhance children’s learning, development, engagement, initiative, self-worth, dignity and show respect for their contributions.
All staff in the childcare should know and practice about Early Childhood Code of Ethics in every day work.
A poster about the code of ethics should place every room in the childcare centre.

2. Education and Care Services National Law Act 2010.
Look at the objectives and guiding principles, Part 1 on pages 13 and 14
• The objective and guiding principle in Education and Care Services National Law Act 2010 ensure the safety, health and wellbeing of children attending education and care services.
• This improves the educational and developmental outcomes for children attending education and care services.
We can implement these in our child care by giving adequate training to our staff members regarding Education and Care Services National Law Act 2010.
3. Child Protection Act 1999.
Part 3 on page 30 and 31
• It clearly defines who is child, parent etc.
• It makes an idea about harm and which child needs protection from harm.
Every childcare centre should keep a copy of child protection act in the centre. Then the staff can read the copy. This helps them to understand the Child Protection Act.

4. Commission for Children and Young People and Child Guardian Act 2000.
Refer to Principles for administering this Act on pages 26 and 27. Look at section 6 c)
• This act ensure every child is a valued member of society;
• Every child is entitled to be treated in a way that respects the child’s dignity and privacy; and
• This Act is to be administered under the principle that the welfare and best interests of a child are paramount.

This can be implement in our childcare by staff should follow strict and necessary guidelines in order to keep each child safe and secured in the centre environment. When working in childcare is our duty of care to take on the responsibility of each individual child under our care .
5. Anti-discrimination Act 1991.
Look up section 7) (1) (e)
• In childcare this Act prohibits discrimination on the basis of the following attributes sex, parental status, age, race and religion.
• This Act promote equality of opportunity for everyone by protecting them from unfair discrimination in certain areas of activity, including work, education and accommodation.
Educators should observe and listen to children’s play and adult interaction to identify any bias or discrimination, then develop methods to deal with issues that arise. into play.
Educator should support children’s identity and sense of belonging.
6. Equal Opportunity in Public Employment Act 1992.
Look up page 4, Section 4 (1)
• This Act promotes equality of employment opportunity in the public sector.
• This act eliminates unlawful discrimination by the agency or its employees against members of the target groups with respect to employment matters.
Childcare should implement this act by everyone in the workplace has rights and responsibilities under equal opportunity and antidiscrimination legislation.
Childcare should commit to ensuring all of its staffs are free of discrimination and harassment.
7. Guide to the Education and Care Services National Law and the Education and Care Services National Regulations 2011.
Look at Part 4.5 – Relationships with children – Quality Area 5 – Interactions with children
• All staff should interact with each child in warm, responsive manner and build trusting relationships.
• Every child is able to engage with educators in meaningful, open interactions that support the acquisition of skills for life and learning.
Encourage children to express themselves and their opinions
Allow children to undertake experiences that develop self-reliance and self-esteem
Maintain the dignity and rights of each child
Give positive guidance and encouragement to each child
Consider the family and cultural values, age, and physical and intellectual development and abilities of each child.

• Children will be adequately supervised at all times in accordance with the regulations on child/staff ratios for each section.
• The equipment and facilities will be checked quarterly by the occupational health and safety representative, to ensure they are safe. Defective or unsafe items will be isolated and immobilised until such time as the necessary repairs have been completed or the item replaced.
• Any broken piece of indoor or outdoor equipment must be removed to handyman’s room
as soon as possible to ensure it is not put out for use.
• All equipment at the Centre is to meet approved Australian safety standards.
• The outdoor area is to be surrounded by a child safety fence.
• Outdoor equipment is to be checked and relocated on a weekly basis.
• Staff must check the outdoor environment for dangerous items and dispose of appropriately.
• Dangerous products are to be stored correctly

Michael should write an incident report to the parent. The report contains the following information

• Name, gender, and age of the injured child
• Date and time of injury
• Location where the injury took place
• Description of how the injury occurred
• Names and contact information of witnesses to the accident, as well as what the child reported
• Body parts involved
• Description of any consumer product involved
• Name and location of staff responsible for supervising the child at the time of the incident
• Actions taken on behalf of the injured following the injury
• Recommendations for preventative strategies for the future
• Name of person completing the report, and name and address of the program
Every childcare program should have a written policy and procedure for documenting and reporting incidents. For example, Michael might require several signed copies of the completed injury report form. Copies should be given to the child’s parent or legal guardian and also maintained in the child’s folder.
Depending on our state’s specific childcare injury regulations and the specifics of the incident, we may file additional copies with our state licensing agency or health consultant. A copy may also be maintained in a chronologically filed injury/incident log. Periodic review of the injury/incident log may reveal patterns of injury.
